🛒 Terms and Conditions of Trendelle (AGB)

1. Scope of Application
These Terms and Conditions apply to all purchases made via the online shop www.trendelle.de, operated by:

These Terms apply to both consumers (according to Art. 2 para. 1 Directive 2011/83/EU) and businesses within the meaning of § 14 BGB.
2. Contract Formation
Product listings on our website are non-binding and do not constitute a legal offer. A purchase contract is concluded upon receipt of a written order confirmation by email or upon dispatch of the goods (§ 145 ff. BGB).
3. Prices and Payment
All prices are stated in euros (€) and include statutory VAT where applicable. Shipping costs are calculated separately during checkout.

Bank transfer (prepayment)
Payment is due immediately upon order confirmation unless otherwise agreed (§ 271 BGB).
4. Shipping and Delivery
Standard worldwide delivery: within 1–3 business days after payment confirmation
Express delivery in Berlin: within 8–12 hours (same-day or overnight, if available)
Shipping costs are borne by the customer unless stated otherwise
Delivery is made via third-party logistics providers
Risk of loss passes to the buyer upon handover to the shipping carrier (§ 447 BGB for business customers).
5. Right of Withdrawal (Consumers Only)
Consumers have a right of withdrawal under § 355 BGB and Art. 9 Directive 2011/83/EU. You may cancel your purchase within 14 days without giving any reason.
To exercise your right, send a clear statement by email to shop@trendelle.de. We will confirm receipt.
Exclusion of the Right of Withdrawal (cf. § 312g BGB):
No return will be accepted in the following cases:
Product shows signs of use or wear
Original tags or packaging are missing
Hygiene seals are broken
Items are personalized or custom-made
Customers bear the direct cost of return shipment (§ 357 BGB).
6. Retention of Title
Goods remain the property of Trendelle until full payment has been received (§ 449 BGB).
7. Warranty and Liability
Statutory warranty rights apply (§§ 434 ff. BGB).
For commercial buyers, warranty is limited to 12 months.
Trendelle is only liable for damages caused intentionally or by gross negligence (§ 276 BGB), except in cases of injury to life, body, or health (§ 309 No. 7 BGB). Claims under the German Product Liability Act (ProdHaftG) remain unaffected.
8. Data Protection (GDPR)
We process personal data in compliance with the General Data Protection Regulation (GDPR, Regulation EU 2016/679) and the Federal Data Protection Act (BDSG).
Processing is based on Art. 6 para. 1 lit. b GDPR (contract performance) and Art. 6 para. 1 lit. f GDPR (legitimate interest).
Data is shared with third parties (e.g., shipping providers, payment processors) only where necessary.

9. Jurisdiction and Applicable Law
All contracts are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on the International Sale of Goods (CISG).
If the customer is a merchant (§ 1 HGB), the place of jurisdiction is Berlin, Germany (§ 38 ZPO).
10. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one which comes closest in economic intent and legal purpose.
